Description:
The objective is to ensure equality between the bankrupt husband and wife towards creditors.
Article 629 in its current form stipulates that: a woman, whose husband was a trader at the time of conclusion of the marriage or did not have at that time a specific trade then became trader within one year from the marriage, does not have the right to file a bankruptcy lawsuit for the benefits that are stipulated in the marriage instrument. In this case, the creditors do not have the right to use as arguments the benefits that were granted by the wife to her husband in the said instrument.
Grants made during the marriage period are to be considered null as well.
